Students and families often attempt to negotiate with school districts, private schools, colleges, and universities without fully understanding their rights. Often, students need special accommodations, and that realization does not come until after performance issues or disciplinary action is taken. Ribstein & Hogan can assist to negotiate with schools and advocate for the student.
Students and families that need accommodations should understand the difference between IEPs and 504 Plans and should have guidance in securing the necessary evaluation to ensure that necessary accommodations are made. Should a family decide that homeschooling may be the better avenue, a family should seek guidance from an attorney with knowledge of the home school laws, how to exempt their child from school, and how to properly find a home school program that meets the requirements of the state they reside in. Failure to properly do so can result in truancy and attendance issues if the school believes that the student is to be attending, rather than homeschooling.
Ribstein & Hogan Law Firm can assist the higher education student in dealing with the often unclear and high stakes areas of Title IX and University Disciplinary proceedings. These proceedings often place an emphasis on the accuser at the detriment of the accused’s due process. Sometimes, these proceedings may even be an infringement on your First Amendment or other Constitutional Rights. Ribstein & Hogan has the experience to properly fill a University’s “advisor” role in the process, and fight for your rights.
